General Terms and Conditions of Sale


The website www.achikochi.eu (the Site) is the property of ASOKO SAS (the Seller) in its entirety, as well as all related rights. Any reproduction, in whole or in part, is systematically subject to the authorization of the owners. The following conditions apply only to products purchased on the Site.

ARTICLE 1 - PRODUCTS

1-1. The main characteristics of the Products offered for sale on the Site and in particular the specifications and maintenance instructions presented on the Site are required to be consulted by the Customer before any order is placed. The choice and purchase of a Product is the sole responsibility of the Customer.

1-2. The Site strives to make the photos of the Products as accurate as possible. However, due to the natural materials used, the fact that the products are handmade by craftsmen (each element is unique), the Site cannot guarantee the exact representation of colors and patterns of materials. Although great care is taken in the descriptions and ratings, slight variations may remain.

1-3. These General Terms and Conditions (GTC) are available at any time on the Site and prevail over any other document. The Customer declares that he/she has read these GTCs before implementing the online ordering procedure for the Site.


ARTICLE 2 - ORDERS

2-1. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order. Any order placed on the Site constitutes the formation of a contract concluded at a distance between the Customer and the Seller.

2-2. The sale will be concluded upon confirmation of the order. The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to check the accuracy of the order and to immediately report any errors.

2-3. The information provided by the Customer when placing the order is binding on the Customer. In the event of an error in the wording of the recipient's contact details, the Seller shall not be held liable for any inability to deliver the Product.

2-4. The Seller shall not be liable in the case of a shipment of Products for which there are laws or import restrictions in the country of destination.


ARTICLE 3- PRICE

3-1. The prices indicated on the Site are in euros and are inclusive of all taxes (French VAT included). Any possible change in the legal rate of French VAT will be reflected in the price of the Products presented on the Site.

3-2. The prices of the Products do not include the shipping and gift packaging costs, which are the responsibility of the Customer and which will be specified to him when placing his order.

3-3. The prices presented may be modified at any time by the Seller.

3-4. The total payment requested from the Customer corresponds to the total amount of the purchase, including transport costs. An invoice is issued by the Seller and delivered to the Customer upon delivery of the Products ordered.


ARTICLE 4- DELIVERY

4-1. Orders can be delivered in metropolitan France, as well as in Europe. If the country of delivery or postal service in force in the country is not considered safe, the Seller reserves the right to refuse an order. This will be refunded within 3 working days.

4-2. The delivery of the Products takes place before receipt of payment for the order, at the delivery address indicated by the customer. Packages are shipped with the delivery note, to the delivery address indicated by the Customer when ordering. The Customer chooses the carrier that is proposed by the Seller. In case of unusual delay, an email will be sent to the customer.

4-3. The Seller undertakes to make its best efforts to deliver the products ordered by the Customer. Delivery will be made as soon as possible after your order has been accepted and depending on the availability of the Product. The Customer will be notified for Products that are not in stock and require a manufacturing delay.


ARTICLE 5 - Conditions de paiement

5-1. The Product is paid by secure payment, according to the following terms:

  • Payment by credit card,
  • Payment by PayPal

5-2. The Product is payable in cash by the Customer, in full on the day the order is placed.

Payment data is exchanged in encrypted mode using the protocol defined by the authorised payment service provider involved in banking transactions on the Site.

5-3. Payments made by the Customer shall only be considered final after the Seller has actually collected the sums due. The Seller shall not be required to deliver the Products ordered by the Customer if the latter does not pay the full price in accordance with the conditions indicated above.


ARTICLE 6 - RIGHT OF RETURN (RETRACTATION)

6-1. The Customer checks his order on delivery, this control must include the quality, quantities and references of the goods, as well as their conformity with the order. If the Customer is not satisfied with his purchase, he has the possibility to return the product within 7 working days. This right of withdrawal is exercised without penalty.

6-2. In the event of an exchange or refund, the request must be made by e-mail to the Seller, who will provide the Customer with instructions for the return of the goods. The items must be returned in their original packaging, intact and accompanied by any accessories, instructions and documentation. Damaged, soiled or incomplete Products are not taken back. The return costs remain the responsibility of the Customer.


ARTICLE 7 - LIABILITY

7-1. The Seller declines all responsibility for any consequences that may arise from the use of the Products sold on the Site.


ARTICLE 8- INTELLECTUAL PROPERTY

8-1. All Content (downloadable documents, iconographic and photographic representations) on the Site are the property of the Seller and are protected by French and international intellectual property laws. Any total or partial reproduction of this Content is strictly prohibited, and may constitute a counterfeiting offence.


ARTICLE 9 - APPLICABLE LAW - LANGUAGE

9-1. These GTC and the operations resulting from them are governed by and subject to French law.

9-2. These GTC are written in French. In the event that they are translated into one or more foreign languages, the French text alone shall prevail in the event of a dispute.


ARTICLE 10- Dispute

10-1. These GTC are subject to French law. Any dispute arising from the interpretation of these provisions shall be submitted to the courts.
